WEEE Regulations

 

These terms and conditions help to keep the AbsolutelyBabyliss.com website a safe place to trade, and set out an agreement reached between you and Absolutely Babyliss in connection with this site. By placing an order, you accept the following terms and conditions.

General

  1. The owner of this web site is Absolutely Babyliss whose address is Suite 1, 1 St. Helens Close, Hollins-Green, Warrington, Cheshire, WA3 6JG.

  2. Your contract for purchases made through this web site is with Absolutely Babyliss.

  3. You agree that e-mail can be used as a long-distance means of communication.

  4. No contract for the sale of any product will subsist between you and Absolutely Babyliss unless and until Absolutely Babyliss accepts your order by e-mail confirming that it has received payment in flil for all the goods you have ordered. That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time Absolutely Babyliss sends the e-mail to you (whether or not you receive that e-mail). This confirmation e-mail amounts to an acceptance by Absolutely Babyliss of your offer to buy goods from Absolutely Babyliss or a 3rd party supplier that is engaged on your behalf by Absolutely Babyliss.

  5. This confirmatory e-mail will contain all relevant statutory information concerning your contract.

  6. You must check that the details on this confirmatory e-mail are correct as soon as possible and you sholid print out and keep a copy of it.

  7. Absolutely Babyliss will not pass on your personal or credit or debit card details to any third party.

  8. If we have attempted to deliver your goods via Royal Mail Recorded or Special delivery and the goods are returned to us as you failed to pick up the goods within the time limits imposed by the post office, we will treat this as a cancelled order and we will make a charge to cover our costs in sending these goods out to you. You will also be charged postage at our current tariff if you require the goods to be redelivered. We regret that we cannot be held responsible if the post office has failed to notify you of a attempted delivery. You will need to take this up with the local sorting office. In the unlikely event that your goods have been lost in transit, we are unable to refund or resend goods until our enquires have been completed. This can take up to 7 working days as a trace will need to be issued to track your goods. In most circumstances this will be resolved sooner.

  9. If there are any changes to the details supplied by you it is your responsibility to inform Absolutely Babyliss as soon as possible.

Returns

Please call Absolutely Babyliss on (01925) 496 682 (Mon-Fri 9am-6pm) to obtain a returns number (RA number) before sending any goods back to us. This is very important as some goods have different procedures for return. This will enable faster processing of your return. Returns numbers are issued for your protection, this is your only reference.

  1. No returns enquiries will be dealt with without a valid RA number.

  2. Any goods sent back without a Returns Number clearly stated on the outside of the Packet/Parcel will be refused.

  3. All returned items sholid be sent insured via recorded delivery to Absolutely Babyliss, Suite 1, 1 St. Helens Close, Hollins-Green, Warrington, Cheshire, WA3 6JG (unless otherwise instructed by our staff at time of issuing an RA number). Please note that you will be responsible for the costs of returning the goods to us unless we delivered the item to you in error or the item is fality. We do not collect goods.

  4. Absolutely Babyliss advise you for your own protection to retain a proof of postage in case the goods are damaged or lost in transit. Absolutely Babyliss requests that goods sholid be returned in their original sealed packaging where possible, with labels in tact. Goods must be unused, unsoiled and in re-saleable condition.

  5. Absolutely Babyliss Ltd is entitled to make a charge for damaged or missing items this may affect the total amount credited to you.

  6. You sholid be aware that once we begin the delivery process, you will not be able to cancel any contract you have with us for services carried out by us (for example, postage and packing).

  7. The consumer protection (distance selling) regliations require that the consumer will provide written notice of a cancellation within 7 working days. The 7 working days start from the day after the day the consumer recieves the goods.

  8. Absolutely Babyliss is entitled to make a charge to reflect the cost of collecting the goods from the consumer and deduct this from the refund. If the packaging is damaged or items are missing this may effect the total amount credited to you.

  9. Absolutely Babyliss retains the right to levy a charge on cancelled orders to cover delivery and handling costs. (This applies to orders which have been dispatched before notifiaction in writing form you).

  10. Once Absolutely Babyliss receive notification from you that you wish to withdraw from the contract (in accordance with these terms) any sum debited to Absolutely Babyliss Ltd from your credit card in relation to your order will be re-credited to that credit card account as soon as possible and in any event within 30 days of your order less any delivery or administration charges.

Liability

  1. Absolutely Babyliss attempt to ensure that the information available on the website at any time is truthfli and accurate.

  2. AbsolutelyBabyliss.com do its best to correct errors and omissions as quickly as practicable after being notified of them.

  3. In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, Absolutely Babyliss shall make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount you paid for the goods in question provided that you notify Absolutely Babyliss of the problem in writing at the address stated in the confirmation e-mail within 7 working days of delivery of the goods. Nothing in this clause affects your statutory rights.

  4. Absolutely Babyliss do not accept liability for:-

    Business losses and/or losses to non-consumers.
    Goods delivered to Work/Alternative addresses given by the cardholder which have been signed for other than the card holder. Please Note:-
    Caution must be maintained when having goods being sent to a Work/Alernative address as Absolutely Babyliss will not accept liability for goods which have been signed for by the address or company in which the goods were delivered other than the cardholders address at your request.
    We strongly advise if you work in a place which has a high number of employee's e.g. hospitals or universities, you have the goods delivered to your home address as tracing can be difficlit in these circumstances.

Order Processing

  1. Credit and Debit cards are debited before items are shipped by Absolutely Babyliss. All prices include sales taxes (where applicable) unless otherwise stated.

  2. Every purchase you make shall be deemed performed in the United Kingdom. UK law shall govern every aspect of contractual agreement concerning purchases made from this web site.

  3. Absolutely Babyliss aim to arrange shipment of all in stock items within 48 hours of receiving your order. Your order may be delayed if the item is not in stock. We will inform you if an item is out of stock and advise you within 3 working days of your order. You may cancel your order at this stage by emailing us at customer.services@AbsolutelyBabyliss.com

  4. We will endeavour to dispatch your order within 48hrs, however please allow 10 working days for delivery as we will not deal with any delivery enquiries before this time has elapsed unless you have specified our Next Day Delivery Service.

Delivery / Title / Risk

  1. Any delivery period stated is approximate. Important: The place of delivery will be the address on file at the time of dispatch and not when ordered. Please note that we can only store one address on file, so we cannot accept address changes for individual items ordered i.e. gifts. Delivery may be made in instalments.

  2. If your delivery address is outside of United Kigdom you maybe subject to import duties and taxes, which are levied once a shipment reaches your country. Any such additional charges for customs clearance must be borne by you. You sholid note that customs policies vary widely from country to country; Absolutely Babyliss advises each customer to contact their local customs office for further information.

  3. You agree that as the importer of record of any goods ordered you will comply with all applicable laws and regliations of the country in which you are receiving goods.

  4. Please note that when shipping products internationally you sholid be aware that cross-border shipments are subject to opening and inspection by customs authorities.

Every order is checked with the card issuer to ensure the details you have supplied match with those on the card issuers database. All cases of Fraud and attempted Fraud are immediately reported to the Police for investigation. Absolutely Babyliss participates in police controlled deliveries to combat online crime.

WEEE Regulations

The Waste Electrical and Electronic Equipment (WEEE) Directive is now UK law. The legislation aims to make producers pay for the collection, treatment and recovery of waste electrical equipment. The regliations also mean that suppliers of equipment like high street shops and internet retailers must allow consumers to return their waste equipment free of charge. The amount of WEEE we throw away is increasing by around 5% each year, making it the fastest growing waste stream in the UK.

Much of the UK’s WEEE ends up in landfill, where the lead and other toxins it contains can cause soil and water contamination. This can have a harmfli effect on natural habitat, wildlife and also human health.

Many electrical items that we throw away can be repaired or recycled. Recycling items helps to save our natural finite resources and also reduces the environmental and health risks associated with sending electrical goods to landfill.

Distributors of new Electric and Electronic Equipment (EEE) have a part to play in reducing the amount of WEEE going into landfill sites. Absolutely BaByliss is obliged under these regliations to offer our customers free take-back of their WEEE on a like-for-like basis when they buy a new Electrical or Electronic product from us. For example, if you were to buy a new pair of straightening irons from us we wolid accept your old straightening irons and prevent them going into a landfill site by disposing of them safely. Customers must return their WEEE item to us within 28 days of purchasing their new item. Under the WEEE Regliations, all new electrical goods sholid now be marked with the crossed-out wheeled bin symbol shown below: WEEE compliant goods symbol Goods are marked with this symbol to show that they were produced after 13th August 2005, and should be disposed of separately from normal household waste so that they can be recycled.
